Month-to-Month Laws

Termination Notice – 60 days is required for the landlord or tenant to terminate. The notice must be in writing, and the 60-day notice starts on the first day of the month following the date when the notice is given. (§ 5106(d))

Increasing Rent – Delaware law states that landlords must give a 60-day notice before increasing the rent amount for month-to-month leases. The notice must detail the new rent amount and specify when the change will start. (§ 5107(a))
