Disclosures 

Lead-Based Paint Disclosure – Landlords of properties built before 1978 are federally mandated to educate their tenants on the dangers of lead-based paint, disclose if there is any hazardous material on the interior walls of the property, and provide information on how to limit and treat contact with the substance.

Rent Grace Period

Tenants have 5 days to pay their rent in Arkansas. (Ark. Code Ann. § 18-17-701)

Security Deposit

Maximum Amount – A landlord can charge up to 2 months’ rent for unfurnished units and up to 3 months’ rent for furnished rentals.

Returning – The landlord has 60 days to return the security deposit, minus any deductions for damages or unpaid rent. (Ark. Code Ann. § 18-16-305(a)(1))

  • Deductions – Any portion held must be outlined in a written itemized list. (Ark. Code Ann. § 18-16-305(a)(2))
  • Tenant Doesn’t Forward New Address – If the landlord cannot locate the tenant after reasonable efforts, the landlord can keep the payment after 180 days from when the payment was made. (Ark. Code Ann. § 18-16-305(2))
