Disclosures

Lead-Based Paint Disclosure – If the landlord is renting a property built before 1978, they must disclose the possibility of toxic lead paint being present. (EPA/HUD Fact Sheet)

Methamphetamines – If the property has ever been known to manufacture methamphetamines, then the landlord must disclose this information to the tenant. (§ 43-32-30)

Rent Grace Period

There is no rent grace period in the state of South Dakota. The tenant must make the payment on time.

Security Deposit

Maximum Amount – South Dakota laws state a maximum security deposit may not total more than one month’s rent. (§ 43-32-6.1)

Returning – The tenant must receive their security deposit back within 2 weeks of the lease’s end. (§ 43-32-24)

  • Deductions – Within 45 days of the lease’s end, the tenant may request a list of deductions from the security deposit. (§ 43-32-24)
