New Hampshire standard residential lease agreement must be signed by both parties upon the lease start and complied with for the entire length of the contract. The tenants will be responsible for paying rent on time and covering the security deposit and other agreed-upon fees requested by the landlord. The tenant may be subject to a credit check to verify employment and ensure they can cover the rent costs.

Disclosures

Copy of the Lease – The tenant must receive a signed copy of the lease within 30 days of the lease’s start. (Consumer Sourcebook – Renting, Security Deposits, and Evictions)

Lead-Based Paint Disclosure – If the building was constructed before 1978, the landlord must provide the tenant with a lead-paint disclosure due to the toxic nature of lead paint. (EPA/HUD Fact Sheet)

Move-In Checklist – Within five days of the lease start, the tenant must provide the landlord with a written list of any repairs needed. (RSA 540-A:6(I)(c))

Security Deposit Receipt (conditional) – The landlord must provide a security deposit receipt if the tenant does not pay via check. (RSA 540-A:6(I)(b))

Rent Grace Period

There is no rent grace period in New Hampshire. The tenant must pay rent on the lease agreement’s agreed-upon day.

Security Deposit

Maximum Amount – The maximum security deposit is $100 or one month’s rent, whichever is greater. (RSA 540-A:6(I)(a))

Returning – The landlord must return the security deposit to the tenant within 30 days of the lease end date. (§ 46:8-21.1)

  • Deductions – If deductions have been made to the security deposit, a list detailing why they have been made must accompany the security deposit. (§ 46:8-21.1)
  • Tenant Doesn’t Forward New Address – The tenant must notify the landlord of their new address within 30 days of moving out.
