Disclosures

Lead-Based Paint Disclosure – Federal law requires the landlord to disclose the possibility of lead paint if they rent a property built before 1978.

Property Condition Statement – The tenant and landlord must sign an itemized condition report/checklist detailing the state of the property. (§ 47-16-07.2)

Rent Grace Period

There is no rent grace period in North Dakota. The tenant must pay rent on time, or they may be served a 3-day notice to quit. (§ 47-32-01(4))

Security Deposit

Maximum Amount – The maximum amount a landlord may charge for a security deposit is one month’s rent. (§ 47-16-07.1(1))

Returning – The security deposit must be returned to the tenant within 30 days of the lease’s end. (§ 47-16-07.1(3))

  • Deductions – If the full security deposit is not returned to the tenant, the landlord must provide a written account of any damages to the property. (§ 47-16-07.1(3))
