Washington D.C. Standard Residential Lease Agreement

A Washington D.C. lease agreement is a document outlining all of the necessary information for renting a residential property for one year. Both the tenant and renter must sign this legally binding contract. In many cases, the renter may have to come up with a security deposit and may also be subject to a credit check.

Required Disclosures (7)

Bedbug Facts Sheet – If there has been a bedbug infestation in the unit within the last 120 days, the landlord must disclose this information to the tenant. (Bedbug Control Act of 2022)

District of Columbia Tenant Bill of Rights – The landlord must provide their tenant with a copy of the Tenant Bill of Rights. (§ 42–3502.22(b)(1)(L))

Lead-Based Paint Disclosure – If the landlord is renting a home built before 1978, they must provide their renter with a lead paint disclosure.

RAD Form 3 – This form gives information to the tenant on the property’s condition.

RAD Form 5 – This must be provided to the tenant, and it must give information on the property’s safety and accessibility.

Receipt – A receipt must be provided to a renter that pays the landlord in cash. (§ 14-306)

Voter Registration Packet – This booklet, which must be provided to tenants, includes information on the Board of Elections and offers voter forms. 

Rent Grace Period

The tenant has a 5-day grace period for late rent payments. (§ 42–3505.31(b)(2))

Security Deposit

Maximum Amount – In Washington, D.C., a landlord may charge a security deposit of one month’s rent. (§ 14-308)

Returning – The security deposit must be returned to the renter within 45 days of the lease’s end. (§ 14-309)

  • Deductions – If the entire security deposit is not returned to the tenant, then the landlord must provide a list within 30 days. (§ 14-309.2)
