Disclosures 

Landlord Contact Details – The landlord’s or property manager’s name and address must be included in the lease. (§ 5105)

Landlord-Tenant Laws – When the renters sign the rental agreement, the landlord must give them a copy of the Summary of the Landlord-Tenant Code. (§ 5118)

Lead-Based Paint Disclosure – For properties built before January 1, 1978, federal law mandates landlords inform potential tenants of any known lead-based paint on the interior walls of the rental premises, as well as a pamphlet on how to limit exposure and identify symptoms associated with the hazardous materials.

Rent Grace Period

There is no rent grace period in Delaware.

Security Deposit

Maximum Amount – No more than 1 month’s rent. (§ 5514(a))

Returning – The landlord has 20 days to return the security deposit. (§ 5514(b))

  • Deductions – The landlord has 20 days to provide an itemized receipt with a list of all damages and estimated repair costs. (§ 5514(e))
  • Tenant Doesn’t Forward New Address – They have 1 year to claim the security deposit’s balance. (§ 5514(h))
